British chip architecture designer Arm (NASDAQ:ARM [https://seekingalpha.com/symbol/ARM]) said it intends to appeal a judge's ruling in a licensing dispute against Qualcomm (NASDAQ:QCOM [https://seekingalpha.com/symbol/QCOM]) that left the American company's jury victory intact.
"Arm remains confident in its position in its ongoing dispute with Qualcomm and will immediately file an appeal seeking to overturn the judgment," the company said in an emailed statement to Seeking Alpha.
Last year in December, an eight-person jury in the Delaware federal court found that Qualcomm (NASDAQ:QCOM [https://seekingalpha.com/symbol/QCOM]) did not breach [https://seekingalpha.com/news/4389440-jury-finds-qualcomm-did-not-breach-nuvias-license-agreement-with-arm#hasComeFromMpArticle] its unit Nuvia's license agreement with Arm (NASDAQ:ARM [https://seekingalpha.com/symbol/ARM]). The jury added that Qualcomm's custom CPUs, which are used in Microsoft (MSFT [https://seekingalpha.com/symbol/MSFT]) PCs, are licensed legally as part of its existing deal with Arm.
The jury reached a verdict on two out of three counts, and deadlocked on the third count, which resulted in a mistrial, Reuters reported [https://www.reuters.com/business/arm-plans-appeal-final-ruling-qualcomm-dispute-2025-10-01/].
Arm had requested Judge Maryellen Noreika to either throw out the verdict on the two counts where Qualcomm won or have a new trial. The judge declined Arm's requests, the report noted.
Qualcomm did not immediately respond to a request for comment from Seeking Alpha.
Qualcomm noted that the decision affirmed its position that it did not breach its agreement with Arm, the report noted.
"Our right to innovate prevailed in this case and we hope Arm will return to fair and competitive practices in dealing with the Arm ecosystem," Ann Chaplin, Qualcomm's general counsel, said in a statement, the report added.
Shares of Arm fell about 3% premarket on Wednesday, while Qualcomm's stock was largely flat.
