Please read these Terms of Service carefully before using Trading.HK. These Terms govern your access to and use of our platform, products, and services.
1. Acceptance of Terms
By accessing or using Trading.HK (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. We reserve the right to modify these Terms at any time, and your continued use of the Platform constitutes acceptance of any changes.
2. Eligibility
You must be at least 18 years old to create an account and use the Platform. By using Trading.HK, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Account Registration
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. No Financial Advice
Trading.HK provides data analytics, backtesting tools, strategy reports, and educational content for informational purposes only. Nothing on this Platform constitutes financial advice, investment advice, trading advice, or any other sort of professional advice. You should not treat any of the Platform's content as such. We do not recommend that any financial instrument should be bought, sold, or held by you. Trading involves substantial risk of loss and is not suitable for every investor. Past performance of any strategy does not guarantee future results. Always do your own research and consult with a qualified financial advisor before making investment decisions.
5. Subscription and Payments
Certain features of the Platform require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our Pricing page. Subscription fees are billed in advance on a monthly or annual basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are provided at our sole discretion. We reserve the right to change our pricing with 30 days advance notice.
6. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, strategy reports, backtesting results, software, algorithms, and data compilations, is the property of Trading.HK or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written consent. Your subscription grants you a personal, non-transferable license to access and use the content for your own personal, non-commercial purposes.
7. User Conduct
You agree not to: (a) use the Platform for any illegal purpose; (b) attempt to gain unauthorized access to our systems or other users' accounts; (c) interfere with the proper functioning of the Platform; (d) scrape, spider, or use automated means to access the Platform without our consent; (e) redistribute, resell, or commercially exploit Platform content without authorization; (f) upload or transmit malicious code, viruses, or harmful content; (g) misrepresent your identity or affiliation.
8. Data Accuracy and Limitations
While we strive to provide accurate data and analytics, we do not warrant that the information on the Platform is complete, accurate, or current. Market data is sourced from third-party providers and may be delayed or contain errors. Backtesting results are hypothetical and based on historical data; they are subject to inherent limitations including but not limited to survivorship bias, look-ahead bias, and model overfitting. We make reasonable efforts to control for these biases but cannot eliminate them entirely.
9. Limitation of Liability
To the maximum extent permitted by law, Trading.HK and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or trading losses arising from your use of the Platform or reliance on any content provided. Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Trading.HK and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
11. Third-Party Services
The Platform may contain links to or integrations with third-party services. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to the terms and policies of those services.
12. Service Availability
We strive to maintain Platform availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Platform.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising from these Terms shall be resolved through binding arbitration in Hong Kong under the rules of the Hong Kong International Arbitration Centre (HKIAC), unless you and Trading.HK agree to resolve the dispute in the courts of Hong Kong.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trading.HK regarding your use of the Platform and supersede all prior agreements and understandings.
